Water Disruption Fines:

NOTICE-EFFECTIVE SEP 1st, 2024. The Board met on Aug 7, 2024 to review and update the process and fees for the disruption of water flow (closed checks, open ports, failure to take water on time, not taking all of your water, disruption of water). Ports must be closed and gates must be lifted by Thursday @ NOON.  It is your responsibility to make sure your ports/gates have not been tampered with. All infractions include a probationary period of 1 year from the last infraction.

First Infraction: You will receive a written warning for any disruption to the water schedule. 

Second Infraction:  You will be fined $50.00 . Your water rights will be restored when fine is PAID in full. (+ $25.00 Admin Fee)

Third Infraction: You will be fined $100.00.Your water rights will be restored when fine is PAID in full. (+ $25.00 Admin Fee)

Fourth Infraction: You will be fined $200.00. Your water rights will be restored when the fine is PAID in full. (+$25.00 Admin Fee)

Fifth Infraction and ongoing: You will be fined $300.00 (max.) and the loss of irrigation rights for 2 pump runs. Your water rights will be restored after the suspension and all fines have been PAID in full. (+ $25.00 Admin Fee),

If damages occurred due to your infraction, you are responsible for all damages. Damages must be paid for or repaired before water rights will be restored. 

NOTE: If pictures are requested a $25.00 fee will be assessed to whomever requested them. 

 

NOTICE- EFFECTIVE NOV 1st, 2022. The board met at 7:00pm 9/26/2022 to review the current process for handling ports and gates which are left open by property owners and causing disruption of water flow:  The final decision is as follows:

Effective NOV 1st, 2022: Ports must be closed and gates must be lifted by Thursday @ NOON.  It is your responsibility to make sure your ports/gates have not been tampered with. Each property will receive one written warning if they leave their ports or gates opened and it interferes with irrigation to a neighbor and/or causes a neighbor to have to close your ports/gates to receive their water. This also includes failing to take all of your water or taking your water during a time slot that is not your own.

 

 

CLOSE YOUR PORTS AND REMOVE YOUR CHECKS BY 12PM (noon) THURSDAY .

Past Due Assessments:
You will not be able to order irrigation water if your account goes more than $90.00 past due.
If you continue to let your account go past due, a $15.00 fee will be added on at the end of the month to any accounts that are over $120.00 owed.
If your account reaches $180.00 (approx. 6 months past due plus or minus fees), we will be forced to put a lien on your property. You will be charged a $150.00 lien fee for filing and your lien will stay on  your property until it is paid in full by yourself or must be paid before any sale or refinance of your property is finalized by a title company. If the title company fails to pull the lien, the lien is transferred with the property and rights to water will not be restored until the debt is paid in full and you will have to contact the title company.

Clearance of Ditches: 
For proper maintenance of the ditches, it is imperative that our maintenance personnel are able to reach the ditches. Properties that have trees/shrubs/weeds/etc that hover over 18″ from either side of the ditch and lower than 6 ft from the ground must be trimmed properly. If our maintenance crew has to trim back your trees/shrubs/etc, your account will be billed at a rate of $65/hr and a $60 dump fee. Water Rights will be suspended until it is paid in full and if your account is more than $180 for more than 30 days, a property lien will be placed on your property along with the lien fees ($150.00).  Please keep your property cleaned up at all times.
